Summary of Polish Energy Sector in 2014: legal changes
Year 2014 brought many changes to Polish energy sector. One of the biggest surprises was the fall of fossil fuel prices (reflecting tendency on the international markets) that reached the lowest levels over the years. Polish energy sector also faced many changes from the legal perspective, that have been described by the Energy Regulatory Office and available further in this article.
The most important legal changes in 2014, introduced by new
Energy Law are new guidelines for obtaining licenses for manufacturing and sale
of liquid fuels from abroad. Furthermore, the law introduced security on
property, subject to the submission of the applicant to obtain the concession
operator in this regard.
What also has been introduced is a new system of sanctions
for illegally manufacturing or marketing of liquid fuels, including foreign
trade (illegally - without the required license). The legislature has listed in
the provision of competence (Art. 23, paragraph. 1a) the powers of the
President of the URE to control, including the punishment of energy companies
that run the business without the required license.
Among the important amendments to mentioned law, can be
included “the restoration” of support system for energy companies generating
electricity and heat using cogeneration. The Act also identified the percent of
the obligation to obtain and submit to the redemption of certificates of origin
from cogeneration for subsequent years, until 2018.
One should also pay
attention to the changes in law on monitoring and controlling the quality of
fuels, including introducing rules for controlling the quality of solid fuels,
as well as introducing the definition of solid fuels as such. The purpose of
this amendment was to introduce quality control of coal imported into Polish and
warehouses located in the retail trade. Changes made to the mentioned law
are closely related to the advanced legislative work on the draft of another
amendment to the Act - Energy Law, introducing licensing regulations for coal
trading. The draft amendment provides for the President of the Energy
Regulatory Office equipment competence for licensing and control of economic
activity related to trading in coal.
In 2014, took place the amendments to the law on
bio-components and liquid biofuels. The significant changes in this bill should
include the introduction of regulations governing the exercise of economic
activity: the intra-Community acquisition or importation of bio and certifying
compliance with the sustainability criteria and issues concerning the
certification rules. Part of these changes will come into force at the
beginning of 2015.

In 2014 years of intensive legislative work to make significant changes in renewable energy. The proposed amendment provides for an exemption from the Act - Energy Law to separate law provisions relating to renewable energy sources.
Thanks to the large involvement of representatives in the work of the Energy Regulatory Office Agency, cooperation of Energy Regulators (ang. The Agency for the Cooperation of Energy Regulators, ACER) progressed rapidly to harmonize European rules on the functioning of electricity and natural gas.
We hope that 2015 will be reflecting tendency of 2014 and will prove to introduce many positive changes in the sector!
